In these terms and conditions the following terms are used with the meanings given below, unless expressly stated otherwise.

- Mind-Body-Therapie Valk has no diagnostic authority.
Article 3: Support agreement, confidentiality and privacy
- Mind-Body-Therapie Valk has a duty of confidentiality.
- Before the support begins, the client is asked to complete and sign a support agreement and a registration document. In doing so the client explicitly consents to personal data being recorded in the support agreement and the client file.
- The Dutch Medical Treatment Contracts Act (WGBO) applies to this support agreement. Among other things it governs: the right to information, the consent required for treatment, the obligation to keep a client file, the client’s right to inspect that file, and the confidentiality of client data.
- The support agreement has two parts: (a) therapist and client enter into a working relationship for a given period; (b) the support relates to the question and the goals brought in by the client, which may be adjusted during the process.
- By completing the support agreement the client consents to personal data being recorded. The file is kept for 20 years in line with the statutory retention period (for clients under 18, from their 18th birthday).
- Dutch law applies to all agreements with Mind-Body-Therapie Valk.
- For the most effective support it may be necessary to obtain information from, or provide it to, for example the general practitioner, the occupational physician, a life partner or fellow therapists. This only happens after written consent from the client, and only for the episode of complaints concerned.
- Where there is imminent danger to the client or those around them, Mind-Body-Therapie Valk reserves the right to provide relevant information to authorised persons or bodies if danger can thereby be prevented.
- Adverse consequences of withholding information in the file, whether at the general practitioner or at Mind-Body-Therapie Valk, are for the client’s account.
Article 4: Payment terms
- These payment terms apply to all support agreements between the client and Mind-Body-Therapie Valk.
- The rate per session is set out in the support agreement. The client receives a digital invoice, payable within 14 days.
- Rates for contact with people involved with the client (telephone, email and the like) and for drawing up handover reports or files are agreed in advance. These costs are not routinely reimbursed by health insurers.
- Mind-Body-Therapie Valk reserves the right to adjust the rates annually on 1 January.
- If an invoice is not paid on time, a payment reminder may be sent. If payment is still not made within 14 days after that, Mind-Body-Therapie Valk is entitled to take debt collection measures; the costs are for the client’s account.
- In the event of arrears, further support may be suspended until the payment obligation has been met, unless the nature of the support makes this inappropriate.
Article 5: Cancellation
If an appointment is cancelled less than 36 hours before it starts, Mind-Body-Therapie Valk has no choice but to charge the costs agreed in advance.
Article 6: Ending the agreement
The agreement may be ended when: therapist and client jointly establish that no further sessions are needed; the client indicates they no longer want a session; the therapist indicates she can no longer provide sessions; the client repeatedly fails to keep to the arrangements made; or the therapist takes the view that she is not competent to support the client, for example because of a contraindication.
If the therapist ends the agreement part-way through, she will point the client towards where suitable help can be found.
The agreement ends automatically if no new appointment has been made for more than 3 months after the last session, unless agreed otherwise.
